1. Definitions

  • User(s): Refers to any individual or entity accessing or using our website or Services. This includes Pharmacy Clients and Pharmacy Professionals.

  • Pharmacy Professional(s): Refers to pharmacists, pharmacy technicians, or other pharmacy-related personnel seeking employment opportunities through our Services.
  • Content: Refers to any text, images, audio, video, or other materials generated, provided, or made accessible by you or us through the Services, including job descriptions, resumes, and company profiles.

2. Account Registration and Access

2.1. To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2.3. You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement.

2.4. Specific to Pharmacy Professionals: You agree to provide accurate and verifiable information regarding your licensure, certifications, education, and work history. You understand that false or misleading information may lead to immediate account termination.

2.5. Specific to Pharmacy Clients: You agree to provide accurate and verifiable information about your facility, staffing needs, and any relevant compliance requirements. You understand that false or misleading information may lead to immediate account termination.


3. Use of Services

3.1. Permitted Use: You agree to use our Services only for lawful purposes and in accordance with these Terms, all applicable laws, and regulations, including but not limited to healthcare privacy laws (e.g., HIPAA), employment laws, and professional licensing board requirements.

3.2. Prohibited Use: You agree not to use our Services to: a. Post any false, inaccurate, or misleading information about yourself, your qualifications, your company, or job opportunities. b. Transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, or otherwise objectionable material. c. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity. d. Transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships. e. Transmit any Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party. f. Transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment. g. Interfere with or disrupt the Services or servers or networks connected to the Services. h. Collect or store personal data about other users without their express consent. i. Engage in any activity that is fraudulent, misleading, or deceptive. j. Engage in direct solicitations of users outside of our platform for staffing or employment without our prior written consent, specifically bypassing our service fees.

3.3. No Guarantee of Placement or Candidates: We do not guarantee job placement for Pharmacy Professionals or the successful fulfillment of all staffing requests for Pharmacy Clients. Our Service is designed to facilitate connections and streamline the matching process.

3.4. Professional Conduct: All Users are expected to maintain a high level of professionalism and respect in all interactions facilitated by our Services.


4. Fees and Payment

4.1. For Pharmacy Clients: You agree to pay all fees and charges associated with your use of the Services as described on our website, in your service agreement, or as otherwise agreed upon for staffing placements. Payment terms will be specified in your individual client agreement.

4.2. For Pharmacy Professionals: Our Services are generally free for Pharmacy Professionals seeking employment, though premium features may be offered for a fee.

4.3. All fees are exclusive of applicable taxes, and you are responsible for paying any such taxes.

4.4. Failure to pay fees when due may result in suspension or termination of your account and Services.


5. Intellectual Property

5.1. Our Content: All content on our website and provided as part of the Services (excluding User Content), including but not limited to text, graphics, logos, images, software, and intellectual property, is the property of [Your Company Name] or its licensors and is protected by copyright, trademark, and other intellectual property laws.

5.2. 6.1. Both Pharmacy Clients and Pharmacy Professionals agree to treat all non-public information obtained through the Service as confidential, including but not limited to candidate resumes, client staffing needs, facility details, and compensation terms.

6.2. You agree not to disclose, disseminate, or use any confidential information for any purpose other than that for which it was provided through the Services.


7. Background Checks and Verification

7.1. For Pharmacy Clients: You acknowledge that you are solely responsible for conducting your own due diligence, background checks, license verifications, and professional reference checks on any Pharmacy Professionals identified through our Services before making any offers of employment or engaging their services. While we may offer certain screening tools or initial verification processes, we do not guarantee the accuracy or completeness of any information provided by Pharmacy Professionals.

7.2. For Pharmacy Professionals: You agree that Pharmacy Clients, or we on behalf of Pharmacy Clients, may conduct background checks, verify licenses and certifications, and contact references you provide. You consent to such checks as a condition of using our Services to seek employment.


8. Disclaimer of Warranties

SPECIFICALLY, WE DO NOT WARRANT OR GUARANTEE THE SUITABILITY, QUALIFICATIONS, OR PERFORMANCE OF ANY PHARMACY PROFESSIONAL OR THE COMPLETION OF ANY STAFFING PLACEMENT.


9. Limitation of Liability
